Relocation - Child Custody - Parenting Time - Visitation

Relocation raises significant child custody and visitation (or parenting time) issues, especially if the relocation is out of state. If one parent is contemplating moving out of state, both parents should consider consulting with a family law attorney.

Relocation issues include physical custody of the child (or children), visitation, and child support. As with child custody, relocation issues are best worked out between the parents, who are in the best position to determine what is in the best interest of their child and themselves. However, if the parents cannot agree, the courts will make that determination.

After examining what is in the best interest of all the parties, especially the child, the court may change physical custody, awarding physical custody to the parent who is not relocating; modify visitation; and modify child support obligations between the mother and father.
